How interest is actually calculated
Interest runs at 18% per annum on the net tax paid in cash, from the day after the due date until the date of payment. Where ineligible input tax credit has been availed and utilised, the rate is 24% per annum.
Worked example
Tax payable in cash for the month: ₹1,00,000.
Due date: 20 July. Actually paid: 9 August — 20 days late.
Interest = 1,00,000 × 18% × 20 / 365 = ₹986.
Late fee = 20 days × ₹50 = ₹1,000.
Total additional outgo = ₹1,986.
Watch out
Interest is charged on the cash component only, but late fee is charged even when your entire liability is offset by input tax credit. A nil-cash month is not a free month.
Why late fee keeps compounding
GST returns are sequential. You cannot file GSTR-3B for August until July is filed. One missed month blocks every month after it, and each blocked month is accruing its own daily late fee. This is how a single skipped return turns into a five-figure liability within a year.
Consequences beyond the money
1Your buyers lose input tax credit until your GSTR-1 is filed and reflected in their GSTR-2B.
2E-way bill generation is blocked after two consecutive months of non-filing (one quarter under QRMP).
3Continued non-filing can lead to cancellation of registration under section 29.
4A cancelled GSTIN requires a revocation application and all pending returns filed before restoration.
How to reduce what you pay
File the return even if you cannot pay the tax — late fee stops accruing on filing, interest continues only on the unpaid tax.
Clear the oldest pending period first to unblock the chain.
Use any accumulated credit balance to offset liability before paying cash.
Watch for amnesty notifications — the Council has periodically capped late fees for old pending returns.
Taxpex tip
Set your internal filing deadline to the 15th, not the 20th. Five days of buffer eliminates almost every late fee we see in practice.
