Wrong HSN Code on Invoice: Penalty, Tax Impact and How to Correct It

Used the wrong HSN or SAC code? Understand when it is only a procedural error, when it changes tax, the penalty under section 125, and step-by-step correction through credit notes and GSTR-1 amendments.

    Quick answer

If the wrong HSN code did not change the tax rate, it is mainly a procedural lapse: correct it going forward and amend the GSTR-1 HSN summary. If it led to a lower rate, you owe the differential tax with interest, and penalties may apply. A general penalty under section 125 of the CGST Act applies to contraventions without a specific penalty.

    Two kinds of HSN error

    SituationTax impactWhat to do
Wrong code, same rateNone on tax amountFix item master; amend HSN summary in a later GSTR-1
Wrong code, lower rate chargedShort payment of taxPay difference with interest via DRC-03; issue debit note / supplementary invoice
Wrong code, higher rate chargedExcess tax collectedIssue credit note within time limits, or seek refund subject to unjust-enrichment rules

    Interest and penalty

    • Interest on short-paid tax runs at 18% per year from the original due date until payment.
    • If short payment is not due to fraud, paying tax and interest before a notice generally reduces penalty exposure under section 73.
    • Section 125 provides a general penalty for contraventions without a specific penalty; the Council has recommended easing such penalties, so check the current amount.
    • Wrong classification by a buyer's supplier can also affect the buyer's input tax credit if the tax charged is wrong.

    Correction steps

    1. 1Identify all invoices with the wrong code and the period affected.
    2. 2Confirm the correct code and rate, and document the reasoning.
    3. 3For rate differences, issue debit or credit notes to customers.
    4. 4Pay any short tax with interest through DRC-03 and keep the challan.
    5. 5Amend outward supply details and the HSN summary in GSTR-1 within the permitted window.
    6. 6Update the item master so the error cannot repeat.
    Watch out

Credit notes for excess GST must be declared by 30 November following the end of the financial year (or before annual return filing, if earlier).

Repeated mismatches between e-way bills, e-invoices and GSTR-1 are a common reason for scrutiny notices. If you already received a notice about classification, reply with documents rather than a one-line explanation.
