    What is Startup India?

    Startup India is a flagship Government of India initiative launched on 16 January 2016 to build a strong ecosystem for nurturing innovation and startups. It is administered by the Department for Promotion of Industry and Internal Trade (DPIIT) under the Ministry of Commerce and Industry.

    Registration on the Startup India portal (startupindia.gov.in) creates your public startup profile. DPIIT Recognition is the separate, higher-value approval that classifies your entity as a 'Startup' under the official 19 February 2019 notification and unlocks tax holidays, angel-tax exemption, funding schemes and tender relaxations.

    DPIIT Recognition — the badge that actually matters

    DPIIT recognition is issued by the Department for Promotion of Industry and Internal Trade and is the single gateway to every meaningful startup benefit. Without it, you cannot claim the 80-IAC tax holiday, angel-tax exemption, SISFS grants or tender relaxations.

    The step-by-step process

    1. Startup India profile

    Create your public profile on startupindia.gov.in with entity details, founder bios and industry tags.

    2. DPIIT application

    Submit the DPIIT recognition form with the innovation narrative, pitch deck and supporting documents.

    3. Review

    DPIIT reviewers assess the innovation angle, scalability and evidence. They may raise clarifications via email — we respond within 24 hours.

    4. Certificate

    On approval, a Certificate of Recognition is issued with a permanent DPIIT number. This becomes the KYC for every future startup benefit.

    80-IAC — the 3-year income tax holiday

    Section 80-IAC of the Income Tax Act allows a DPIIT-recognised startup to claim 100% deduction of profits for any 3 consecutive assessment years out of the first 10 years from incorporation. This is a separate application to the Inter-Ministerial Board (IMB), not automatic on DPIIT recognition.

    The deduction is elective and irrevocable — once you pick your 3 years, you cannot change them. Most CAs advise picking the 3 years when profits are expected to be highest, typically years 4–7 after incorporation.

    Angel-tax exemption — the founder-saving provision

    Angel tax under Section 56(2)(viib) taxes share premium above fair market value received by an unlisted company from a resident investor as 'income from other sources' at 30% + surcharge + cess. It was the single most-hated provision for Indian startups.

    DPIIT-recognised startups are fully exempt from angel tax provided (a) post-issue paid-up capital + share premium stays under ₹25 crore, (b) shares are issued to resident angels, and (c) Form 2 declaration is filed with DPIIT within 15 days of the allotment.

    Patent & trademark rebates — 80% and 50%

    DPIIT-recognised startups get an 80% rebate on patent filing fees and 50% on trademark filing fees. The Government also empanels IP facilitators whose professional fees are paid entirely by the Government under the SIPP scheme. For most early-stage startups, filing 1–2 patents is genuinely cheaper as a DPIIT-recognised startup than as a small business.

    Common reasons DPIIT applications get rejected

    • Weak or generic innovation narrative — 'we're the Uber of X' doesn't work
    • No proof of concept — no deck, no website, no product
    • Applying as a spin-off or reconstruction of an existing business
    • Applying with expired entity age (>10 years) or breached turnover (>₹100 Cr)
    • Blank or copy-pasted 'problem–solution' section
    • No IP filings and no differentiation from existing solutions
