    Tax Deducted at Source (TDS) is one of the most important and most penalised compliance areas in Indian taxation. Every company, LLP, firm, employer and contractor that crosses the prescribed thresholds must obtain a TAN, deduct tax on specified payments, deposit it monthly and file a quarterly TDS return. This 2026 guide walks you through everything — from the legal framework to the actual filing workflow.

    What is TDS and why does it exist?

    TDS is a mechanism under the Income Tax Act, 1961 that requires the payer to deduct income tax at the source of payment and deposit it directly with the government on behalf of the payee. It accelerates revenue collection, broadens the tax base, and creates a digital audit trail through the deductee's Form 26AS and AIS.

    Who must file TDS returns?

    • All companies and LLPs, regardless of turnover.
    • Partnership firms and proprietors covered by tax audit under Section 44AB in the previous year.
    • Government departments, trusts and other deductors specified in the Act.
    • Any individual or HUF paying rent above ₹50,000/month under Section 194-IB.

    Monthly TDS deposit due dates

    Tax deducted in any month (except March) must be deposited via ITNS 281 by the 7th of the following month. For March, the deposit due date is 30 April. Government deductors paying without challan must deposit on the same day.

    The end-to-end TDS filing workflow

    1. 1Apply for TAN (Form 49B) — one-time activity for every deductor.
    2. 2Identify deductible payments — salaries, rent, professional fees, contractor payments, commission, interest.
    3. 3Deduct at the correct rate based on the section and PAN availability (206AA: higher of 20% or applicable rate).
    4. 4Deposit monthly via ITNS 281 with the correct BSR code, section and assessment year.
    5. 5Reconcile challans on OLTAS and validate every deductee PAN on TRACES.
    6. 6Prepare the quarterly return using the latest RPU/FVU utility.
    7. 7Generate the FVU file, sign and upload on the income tax e-filing portal (or TIN-FC).
    8. 8Capture the token number, download the conso file and generate Form 16/16A from TRACES.
    9. 9Issue Form 16 (annually) and Form 16A (quarterly) to deductees within statutory timelines.
    10. 10Monitor TRACES intimations under Section 200A and file corrections where required.

    Common reasons TDS returns get defaulted

    • PAN not validated — leads to short deduction notices and 206AA application.
    • Challan mismatch with OLTAS — wrong BSR code, date or assessment year.
    • Wrong section code applied to a deductee, triggering rate differences.
    • Late deposit attracting 1.5% per month interest.
    • Salary annexure (24Q Q4) missing employee-level break-up.

    FAQs

    Is TDS return filing mandatory for small businesses?

    Yes, if you have been allotted a TAN and have deducted TDS during the quarter — turnover is not the test. Even a single ₹50,000 rent payment can trigger 194-IB obligations.

    Can I file TDS returns myself?

    Technically yes, using the RPU/FVU utility. Practically, the FVU validation, PAN reconciliation and TRACES default management are error-prone — most defaults we fix come from in-house filings without CA review.
